WebOrbiton – Terms of Service

1. GENERAL INFORMATION
These Terms of Service (“Terms”) govern the use of:
- WebOrbiton self-hosted software (“Software”), and
- WebOrbiton Cloud platform (“Service”).
By using either the Software or Service, the user (“User”) accepts these Terms.
If the User does not agree to these Terms, they must stop using the Software or Service.
The Software is operated by the User locally. The Service is operated by:

2. LICENSES AND USE
2.1 Self-Hosted WebOrbiton
- Governed by WebOrbiton License – Version 1.1 and WebOrbiton Commercial License – Version 1.0.
- Users may modify, fork, or adapt the Software for personal or commercial projects.
- Offering the Software directly as a paid product or SaaS requires Commercial License approval.
2.2 WebOrbiton Cloud
- Users must maintain a valid subscription for paid plans.
- Access is conditional on complying with these Terms and acceptable use rules.
3. ACCEPTABLE USE POLICY (AUP)
The User agrees NOT to:
- Launch or attempt DDoS attacks.
- Attempt unauthorized access to accounts, servers, APIs, or databases.
- Exploit bugs or platform weaknesses for personal gain.
- Reverse engineer Cloud logic or bypass paid limitations.
- Overload the API, abuse trial periods, or distribute malware.

Intentional misuse may result in account termination and legal action.
4. SUBSCRIPTIONS, PAYMENTS, AND REFUNDS (Cloud)
Paid plans are billed monthly or annually.
The User agrees to:
- provide accurate billing information,
- allow automated renewal unless cancelled,
- understand failed payments may suspend access.
Refunds or exemptions apply if:
- Prolonged outages or malfunctions result directly from WebOrbiton Cloud errors.
- Services fail due to bugs or platform faults.
Affected Users may receive:
- pro-rata refunds,
- exemption from subscription fees for the affected period.

Decisions are at WebOrbiton Cloud discretion.
5. FEATURES AND SERVICE LEVELS
Plans (Starter, Pro, Business) may include:
- monitoring frequency,
- uptime history retention,
- alerting,
- API access,
- backup availability,
- status badges.
Service is provided on a best-effort basis, without guaranteed uptime,
unless stated in a separate SLA.
6. ACCOUNT TERMINATION
An account may be terminated if:
1. Terms are violated.
2. Harmful or illegal activity is detected.
3. Subscription payments fail (Cloud only).
4. Deletion is requested.
Upon termination:
- monitoring stops,
- stored data may be deleted after 30 days.
7. LIABILITY AND WARRANTY
The Software or Service is provided “AS IS”.
WebOrbiton Team is not responsible for:
- outages or downtime unrelated to platform errors,
- data loss due to misconfiguration (Software or Cloud),
- indirect or financial damages unrelated to Cloud errors.
Maximum liability is 1 USD, except for Cloud errors causing prolonged
service disruption, in which case refunds or fee exemptions apply.
8. PRIVACY AND DATA PROTECTION (GDPR)
WebOrbiton Cloud complies with GDPR and Polish data protection laws.
Data is processed for:
- providing the Service,
- improving system stability,
- delivering alerts and support.
Data is never sold.
Self-hosted users are responsible for compliance when deploying the Software.
9. TRADEMARKS AND BRAND USAGE
“WebOrbiton”, the logo, favicon, and Cloud branding are trademarks.
Users may not:
- use logos outside the Service or locally without permission,
- publish modified variants implying partnership.
10. FINAL PROVISIONS
These Terms are governed by Polish law.
Disputes are handled by Polish common courts.
Continued use of Software or Cloud implies acceptance of these Terms.
